Fulton County, Georgia Superior Court Judge Robert McBurney has taken down the 2022 abortion law prohibiting abortions beyond six weeks of pregnancy.
McBurney’s argument for overturning this law was that the law was inconsistent with the rights of liberty and privacy, as well as society’s interest in protecting and caring for unborn infants.
When Roe v. Wade was overturned by the U.S. Supreme Court in 2022, the national right to have an abortion had been abolished. States had the right to ban abortion or limit it to six weeks, like Georgia.
Four states, including Georgia, Florida, Iowa and South Carolina are now under the six-week ban exception. These six weeks often occur before women realize that they are pregnant. This also leaves many people in the South with no choice but to travel long distances in order to legally get the abortion procedure done.
